From Convenience to Complexity: The Legal Questions of AI Autonomy
Claude has taken a bold step by offering the ability to control a user’s computer directly, with OpenAI rumoured to follow suit in early 2025. This shift marks a significant leap in what these technologies can achieve. No longer limited to generating text or answering questions, they are now capable of managing tasks across your device: browsing the web, downloading files, or organising local documents. These capabilities push far beyond the automation seen in traditional robotic process automation (RPA), opening up exciting new possibilities but also introducing fresh challenges and questions about responsibility and control.
While these changes bring significant convenience and efficiency, it also raises complex questions about responsibility and accountability.
AI Taking the Lead: Convenience Meets Complexity
Allowing AI models to perform tasks on our behalf can streamline workflows and automate routine activities. I recently experimented with the Open Interpreter AI system that can control your computer. It was cool to be able to say, “Check my emails and see if there’s anything urgent; if there is, can you summarise them,” and have the AI handle it smoothly. This level of control enhances productivity but also prompts important considerations.
Granting AI this level of autonomy inevitably raises the risk of unintended consequences. Let's say a user asks their AI, "I need to compare two scenes in a film, can you help me?" While the user might expect the AI to provide information or analysis based on legitimate sources, the AI could interpret the request as needing the actual video files and inadvertently download a pirated version of the film from an illegal source.
In such cases, determining responsibility becomes a complex challenge. Is the user accountable for the AI's actions? Should the provider be held liable for not implementing sufficient safeguards? Or is this simply an unintended consequence of granting AI models the freedom to act? The line between user intent and the AI’s independent actions blurs, making the assignment of legal responsibility far from straightforward.

Current legal frameworks aren't really equipped to address situations where AI actions result in unlawful activities. Claiming that “the computer did it, not me” challenges traditional ideas about intent and responsibility within the legal system. Users could argue they were unaware of the actions, while AI providers could contend that their models operate based on user inputs and available data - ultimately some people will slip through the cracks here.
And all this raises some questions for me:
User Responsibility
Can users be held accountable for the actions of their AI assistants, even if they didn’t intend those actions? Liability could potentially extend to users if negligence or lack of due care is established.
Provider Accountability
Do AI providers share responsibility if their models facilitate illegal activities due to design flaws or insufficient safeguards? This area may be influenced by data protection regulations and emerging laws concerning AI.
Intent and Agency
How does the concept of intent apply when an AI makes independent decisions that lead to unlawful outcomes? Establishing intent becomes difficult when actions are carried out by an AI rather than a human.
What We Expect: Responsibility in Professional Services
When I was purchasing my first flat, I wondered why I had to commission a coal mining survey for a flat by a river, in the middle of Leeds.... it seemed unnecessary, but I paid for it because that’s what the solicitors recommended. Partly, it was for convenience (...and because I didn’t have the expertise), but mostly because I wanted someone to hold accountable if issues surfaced later, like hidden flood risks or a secret mine in Leeds centre.
In professional services, liability is a significant aspect of what we pay for. Clients rely on experts not just for their knowledge but also for the assurance that someone is responsible if things go wrong. If a solicitor overlooks a critical issue, the client has recourse to hold them accountable for negligence.

In practice, the solicitor would likely remain accountable for the oversight, as their duty of care to the client does not diminish simply because they relied on AI. However, this raises concerns about whether solicitors can trust these tools to support their work without compromising on professional standards.
Maintaining Client Trust
Client confidence is crucial in legal services, particularly when significant assets like property are at stake. If the mechanisms for accountability in AI-driven processes are unclear, clients may be reluctant to rely on such services. Trust is built on clarity and reliability, and any ambiguity surrounding who is responsible when something goes wrong could undermine that relationship.
Insurance and Risk Management
The integration of AI into legal workflows also has implications for professional indemnity insurance. How will insurers adapt to cover errors stemming from AI use? Insurers may well begin to demand additional safeguards, such as certifications or audits of AI tools, to ensure they meet professional standards. This could increase costs but may also serve as a critical step in mitigating risks and ensuring accountability.

Users must be informed about what AI tools can and cannot do. Recognising that delegating tasks to AI does not absolve them of responsibility is crucial for responsible usage.

In fields like law, AI should enhance rather than replace professional judgement. Professionals could use AI tools for increased efficiency but remain accountable for the final outcomes, ensuring that human oversight mitigates potential AI errors.
